Berbician sentenced to death by hanging

A Rose Hall Town man was on Wednesday sentenced to death by hanging by Justice Roxanne George-Wiltshire after a mixed jury found him guilty of murder.
Herman “Shark Oil” Ali was convicted of murdering Roydel Sandy, 41, on October 5, 2006, at Rose Hall Town.
The trial was the first for the October session for the Berbice Assizes.
During the trial, the state called 11 witnesses, who gave testimony which convinced the jury that Ali did commit the act.
Earlier this year, before another judge, a jury failed to come up with a unanimous verdict in the case, forcing a retrial.
When the case began, State Prosecutor Attorney Prithina Kissoon-Ally told the court that the killing stemmed from a misunderstanding between the two men.
On October 5, 2006 about 16:00h, the deceased Sandy was seen with a wound in the vicinity of Ali’s yard. He was picked up and taken to his mother’s home before being rushed to the New Amsterdam Hospital where he died the next day.
Ali was arrested on October 6, 2006, and later charged with the offence of murder
Detective Assistant Superintendent Gary Mc Alistair, Sergeant Coward, and Detective corporals Duke Jack, Ranee Goberdhan and Kenneth Cort, all provided evidence to support the state’s case.
Government pathologist Dr Vivekanand Brijmohan, who also appeared for the state, said that the deceased suffered a gaping wound in the left side of his body.
Asked the direction the instrument would have penetrated the body from, Dr Brijmohan said it appeared to be an upward trust of a sharp instrument, and it could not have been inflicted by an accident.
During the trial, the accused who made an unsworn statement, said he and the deceased did have an altercation on October 5, 2006, and the deceased had a sharp instrument in his hand. He said Sandy during the scuffle fell on his own weapon.
After deliberating on the evidence for two hours, the jury returned with a unanimous verdict of guilty. Asked whether he had anything to say before sentence was passed, Ali said at no time did he have any implement or knife in his hand. “I was not responsible for the killing of Roydel Sandy. I am innocent…” he said as he wept.
